Turfmech has been given the green light in the High Court to continue production of its MaxiMow 13 and MaxiMow 17 large-area trailed hydraulic gang mowers.

The judgement was provided by the Honourable Mr Justice Mann on Wednesday, 7 May, when he dismissed a claim brought against Turfmech Machinery Ltd by Rolawn Ltd and Rolawn (Turf Growers) Ltd for the alleged breach of Rolawn's registered and unregistered design rights in its own wide area mower.

Ordering Rolawn to pay Turfmech's costs in defending the claim, the judge said that he was satisfied that Rolawn's wide area mower and Turfmech's MaxiMow 13 and MaxiMow 17 mowing machines were sufficiently different for the breaches alleged by Rolawn not
to be upheld. As a result of this ruling, Turfmech is able to continue manufacturing and marketing world-wide its MaxiMow range of large-area mowers.

Speaking after hearing the judgement, Turfmech's managing director, Austin Jarrett, commented that the verdict represented a victory for all turf growers and ground staff with large areas of fine turf to maintain who will continue to have access to the widest commercially-produced mower of its type in the world.

"We would have preferred not to have been forced to go to court to defend what turned out to be ill-founded allegations," he said. "We respect Rolawn's right to protect its design rights, but always denied that our MaxiMow large-area mowers infringed those rights and the court agreed with us. I am delighted that we can now get on with what we do best, namely, designing, manufacturing, selling and supporting a first-class range of turf and grounds maintenance equipment."
