Rolawn obtain wins in Advertising Disputes

Rolawn, Britain's leading turf grower and topsoil supplier has won two important disputes with North West Turf Ltd.

In the first, Rolawn challenged North West Turf regarding its website Online Turf and its on line advertisement claiming to be the UK's leading turf grower.

Rolawn's complaint was upheld by the Advertising Standards Authority (ASA), the independent body set up to police the rules laid down in advertising codes in the UK. The ASA concluded that the Online Turf ad was misleading and informed it that any claims it made as to industry leadership must be capable of being substantiated. This was not, and accordingly, the advertisement breached CAP clauses 3.1 (Substantiation), 7.1 (Truthfulness) and 19.1 (Fair Comparison). Details and further information regarding the ASA's decision and findings can be found at: http://www.asa.org.uk/asa/adjudications/Public/TF_ADJ_41820.htm

In the second, North West Turf lodged a complaint with the ASA challenging Rolawn's claim to supply Britain's Finest Turf.

Here the complaint was not upheld and the ASA concluded that the ad was not at all misleading and did not breach any of the CAP clauses. Details and further information regarding the ASA's decision and findings can be found at: http://www.asa.org.uk/asa/adjudications/Public/TF_ADJ_42020.htm

Rolawn is the registered proprietor of UK Registered Trade Mark number 2029865 for the mark "ROLAWN - BRITAIN'S FINEST TURF".

Paul Dawson, Rolawn's Managing Director commented "We are pleased with the outcome of these two disputes especially as the ASA's ruling reconfirms that we can fully substantiate that we do indeed supply Britain's Finest Turf. As a company we will defend our Intellectual Property vigorously and we are currently working closely with our lawyers as there are a number of other claims being made by other turf growers which we consider to be equally as misleading as Online Turf and on which we will be taking action."
